Stage 4 – Defended Claim

Has your claim been defended? Or have you received a claim against you?

What’s Involved:
Mercian Law can assist if you find yourself with a defended claim.  Navigating the complexity of litigation with the assistance of a solicitor can sometimes help keep delays and costs down.

You need to act quickly, as you only have 14 days from the date of service (2 days after the postmark on the envelope) to respond.  If you do not respond on time a judgment may be made against you.

There are various ways a claim can be disputed:

  • Defend the whole claim
  • Defend the whole claim and claim you are owed money with a counterclaim
  • Admit the claim but claim you are also owed money with a counterclaim
  • Defend part of the claim
  • Claim the amount has already been paid

What we need from you:

If you want to admit a claim that has been issued against you, we will need:

  • Details of your income and expenditure, and
  • How you would like to pay. If you pay by instalments a judgment will still be entered
  • The date cleared funds were received or paid if you have already paid or received the amount claimed.

If you want to defend a claim in whole or in part or respond to a defence, we will need:

  • Your comprehensive written comments on every point raised
  • All documentation supporting your comments
  • Proof of any payments made
