VAT will be charged at the current rate in addition to all Mercian Law's fees. Court fees do not incur VAT liability.

1. Pre Litigation & Routine Correspondence

Where there is more than one debtor, for each additional debtor personally served at separate addresses by Mercian Law there is an additional £15 fee per additional debtor.

Notice of Acting

If you have already issued a claim and decide that you would prefer to continue with Mercian Law representing you, we can go on Court Record.  This requires the filing and serving of a Notice of Acting.  We will charge £40.20 + VAT to prepare and send the Notice of Acting to the Court and your opponent.  If there is more than one opponent an additional £20.10 + VAT per Defendant will be charged.

3. In addition to the commencement costs you will be required to pay in advance the following costs on entry of judgement.

4. Defended Claims  

Mercian Law will charge on an hourly rate, currently £201 + VAT, if your claim becomes contested.  The rate will be based on the guideline rates for Summary Assessment 1 April 2010, as published by H M Court and Tribunal Service.

This means that if you win your case, and the claim balance is over £5000, the District Judge may award you a Costs Order for your legal fees to be paid by your debtor, these costs are assessed by the court. It is important that you appreciate that you may not recover all your legal fees as a part of your costs order against the debtor.

All claims issued by Mercian Law will be issued in the debtors local court.

Please note that these hourly rates are based on an 8 year + qualified solicitor dealing with your matter.  The hourly rate may be increased in excess of the above figures, if appropriate,  in substantial and complex litigation where other factors, including the value of the litigation, the level of complexity, the urgency or the importance of the matter, as well as any international element would justify a significantly higher rate to reflect higher average costs.

If you are instructing Mercian Law to defend a claim and bring a counter claim, you will also have to pay a court fee based on the value of your counter claim.  We will also require you to make payment on account of costs at the hourly rate prior to work being commenced.

If the pre-trial checklist (listing questionnaire) fee and hearing fees are not paid when required, the court can make an order which may lead to your statement of case, claim or counterclaim, being 'struck out'.  This would mean that you could nor proceed with your claim or counterclaim.
Mercian Law will send you a disbursement invoice for the fees as and when they fall due.
 
Refunding of a Hearing Fee by HMCS  
Small Claim Track Hearing  
Where a hearing date has been fixed and before the hearing date, the court receives notice in writing at least 7 days before the hearing date that the case is settled or discontinued the hearing fee will be refunded in full.  
Fast-track or Multi-track Hearing  
Where a hearing date has been fixed for a fast-track or multi-track case and before the hearing date, the court receives notice in writing that the case is settled or discontinued, then the hearing fee will be refunded in the following percentages:
100% if the court is notified more than 28 days before the hearing;
75% if the court is notified between 28 and 15 days before the hearing;
50% if the court is notified between 14 and 7 days before the hearing;
no refund if the court is notified fewer than 7 days before the hearing.

6. Applications

7. Appeals

Mercian Law charge £100 plus VAT and process servers costs to serve a statutory demand.

9. Compulsory Liquidation (Winding Up Petition)

Mercian Law undertakes fixed fee work for the preparation of a winding up petition at £402 + VAT and Disbursements.

Costs on entry of Judgment in Possession Proceedings

Mercian Law's charges a fixed fee to attend ordinary possession hearings as your solicitor agent of £175 + VAT

Solicitor Agent

Mercian Law charge £175 + VAT to attend hearings as an agent.  If instructions are cancelled prior to the hearing an abortive fee of £75 + VAT will be payable.
